Embedded content from other websites

nbamaniacs may include embedded content (e.g. videos, images, articles, tweets, Instagram, etc.). Embedded content from other websites behaves in exactly the same way as if the visitor had visited the other website directly.

These websites may collect data about you, use cookies, embed third-party tracking, and monitor your interaction with the embedded content, including tracking your interaction if you have an account and are logged in to that website.

Subscription

You can subscribe to nbamaniacs through the service we offer with the companies Memberful, Mailchimp, and Stripe. This information may include personal data such as your IP address, name, physical address, email address, phone number, and other information. The information you choose to share with nbamaniacs is entirely up to you, as nbamaniacs does not have any user email list, does not send unsolicited emails, and will only respond to emails you have previously sent.

4. Why do we collect data?

The heart of the matter. We explain it in two subsections.

Browsing data

We use this information to analyze trends, manage the site, track users’ movements around the site, and to gather demographic information about our user base as a whole.

We use analytics data to improve our performance, and we do not gain direct financial benefit from it.

Behavioral and preference data

nbamaniacs is funded by advertising. This helps us create new content and keep it free for all users. When you visit our website, your browser automatically sends information to our advertising partners. This information includes the URL of the page you’re visiting and your IP address. Our partners may also set cookies in your browser or read cookies that are already there.

With this data, our advertising partners show you personalized ads so the ads you see are more relevant to you. These ads are more profitable for nbamaniacs because they are more interesting to the user.

However, we also give users the option to disable personalized ads shown on https://nbaen.top. If ad personalization is turned off, our advertising partners will not collect or use your information to personalize the ads you see. You will still see ads, but they may be less relevant. The ads may be based on the context of the website you’re visiting, your current search terms, or your general location, but not on your interests, search history, or browsing history.

Subscription data

nbamaniacs needs your email address and name for a free subscription so we can contact you. For a paid subscription, nbamaniacs also needs your payment data, although we never have access to your credit or debit card information.

5. How will your data be used?

Browsing data

nbamaniacs may use the personal information you provide in a dissociated way (without personal identification) through Google Analytics for internal purposes, such as generating statistics. This way, nbamaniacs can collect, store, or accumulate certain non-personal information related to your use of https://nbaen.top, such as which of our pages are most popular.

We use this information to analyze trends, manage the site, track users’ movements around the site, and to gather demographic information about our user base as a whole.

We also process your IP address for the following purposes:

  • To ensure compliance with the terms of use and applicable law. This may include the development of tools and algorithms that help this website guarantee the confidentiality of the personal data it collects.
  • To support and improve the services offered by this website.
  • We also collect other non-identifiable data through cookies that are downloaded to the user’s device when browsing this website, as detailed in the cookie policy.
  • To manage social networks. nbamaniacs is present on social media. The processing of data from followers of the official pages of https://nbaen.top will be governed by this section, as well as by the terms of use, privacy policies, and access rules of the corresponding social network, which have been previously accepted by the user. We will process your data to properly manage our presence on the social network, inform users of activities, products, or services from https://nbaen.top, as well as for any other purpose allowed by social network regulations. We will never use followers’ profiles to send individual advertising.

In accordance with Regulation (EU) 2016/679 (GDPR), nbamaniacs is the data controller for the data of website users.

nbamaniacs does not sell, rent, or transfer personal data such as name, username, email, or phone number that could be used to identify users — and will not do so in the future — to third parties without prior consent in the event of a change in policy.

The programmatic ads you may see on this website are based on the consent requested here , and withdrawing this consent will not affect the execution of your subscription contract.

The vast majority of programmatic advertising you see on https://nbaen.top comes through Google networks. Google outlines in its privacy policy how it uses information from websites or apps that use its services. You can read Google’s policy here.

Comment data

nbamaniacs’ comment system, Disqus, allows nbamaniacs to:

  • Read published and deleted comments.
  • See anonymized IP addresses and email addresses used to post comments.
  • Read the usernames of all published comments.

The former comment system of nbamaniacs, Spot.IM, allowed nbamaniacs to:

  • Read published and deleted comments.
  • Read the IP address used to post all comments.
  • Read the usernames of all published comments.

Spot.IM and Disqus do not allow nbamaniacs to:

  • Read users’ email addresses in any form.
  • Read personal data (name, surname, social media account) of users who post comments.
  • See the likes given by a user.

With the data we are able to read from Disqus or Spot.IM, we do the following:

  • Analyze the number of comments by day, month, or year.
  • Analyze the number of likes by day, month, or year.
  • Analyze the behavior and engagement of commenters with the news we publish.

Subscription data

The subscription system, powered by Stripe and Memberful, allows us to collect the following information:

  • Email address
  • Name

With this data, we only:

  • Contact you to send emails related to your subscription

Data collected through emails sent for contact purposes

A special case of data processing on nbamaniacs involves emails sent by users to contact our editorial team. Users may ask questions about blog content, send suggestions, or for any other purpose.

Although there is no data collection form, users can send emails for contact purposes. For this, nbamaniacs uses the Gmail (Google) email system. User messages are stored in the nbamaniacs Gmail Suite account, and the corresponding data (email address and name) is processed under the Google privacy policy.

The data stored in the nbamaniacs Gmail Suite account is not shared with or transferred to anyone; you may exercise your legal rights as specified in this privacy policy.

Legal basis for processing your data

The legal basis for processing your data is consent. To contact us or post comments on this website, you must agree to this privacy policy.

6. Who will your data be shared with?

We will not disclose your personal information to third parties, except as described in this Privacy and Data Processing Policy or in the notices established for each case where your personal data is collected.

nbamaniacs may disclose any information, including personal data, that it deems necessary to comply with legal obligations.

Who will your data be shared with?

The tools we use to manage your data are provided by third parties.

To provide services strictly necessary for the operation of https://nbaen.top, we share data with the following providers under their respective privacy conditions:

Google Analytics: a web analytics service provided by Google, Inc., a Delaware company with its main office at 1600 Amphitheatre Parkway, Mountain View (California), CA 94043, USA (“Google”). Google Analytics uses “cookies,” which are text files placed on your computer, to help https://nbaen.top analyze how users use the website. The information generated by the cookie about your use of https://nbaen.top will be transmitted to and stored by Google on servers in the United States.

Users of this website can prevent Google Analytics from using their data by using the Google Analytics Opt-out Browser Add-on for Google Analytics JavaScript (ga.js, analytics.js, and dc.js). Just download it for your browser and activate it.

Hosting: Tecnocrática Centro de Datos, S.L., based in Spain. More information at: https://www.tecnocratica.net/datacenter. Tecnocrática Centro de Datos, S.L. processes data to provide hosting services to nbamaniacs.

Web platform: Automattic Inc., based in the USA. More information at: https://es.wordpress.com/ (Automattic Inc.). Automattic Inc. processes data to provide web platform services to nbamaniacs.

Comment platform: Disqus, located at 717 Market Street, Suite 700, San Francisco, CA 94103, USA. Disqus complies with the European GDPR and processes personal data as a controller — not nbamaniacs. This is the comment system used on nbamaniacs. See section 3 of this Privacy Policy for more on how Disqus handles data. You can read the Disqus privacy policy here.

Former comment platform: Spot.IM, located at 1460 Broadway, New York, NY 10036. More information at https://www.spot.im/about/. Spot.IM complies with the European GDPR and processes personal data as a controller — not nbamaniacs. This was our former comment system. Spot.IM’s privacy policy is here and their GDPR policy is here.

Clickio: the company name is ALZ Software Limited, operating under UK law and based at Unit 2.05, 12–18 Hoxton Street, London, UK, N1 6NG. Gmail Suite: this service stores email messages sent by users for contact purposes.

7. Tool for Users to Accept or Reject Personalized Ads

As explained in section 4 of this Privacy Policy, nbamaniacs is funded by advertising, which allows us to create new content and keep it free for users. When you visit our website, your browser automatically sends information to our advertising partners. This includes the URL of the page you’re visiting and your IP address.

All of this is optional for users visiting nbamaniacs thanks to a consent tool. Clickio, a partner of nbamaniacs, has developed a user consent tool for publishers based on the reference design Google outlines on Cookiechoices.org in accordance with GDPR rules.

If ad personalization is enabled, our partners will use your information to make the ads you see more relevant to you.

If ad personalization is disabled, they will not collect or use your information to personalize ads. You will still see ads, but they may be less relevant. Ads may be based on the context of the website you are visiting, your current search terms, or your general location — but not your interests, search history, or browsing history.

In the tool used by nbamaniacs via Clickio, a pop-up window appears using this reference design. It provides a general notice and requests user consent. The user can click a link to view more details, including a full list of all advertising partners who may access their data.

If the user accepts, personalized ads may be shown.

If the user declines, a second window appears informing them that ads will still be shown, but they won’t be personalized. This message also states that cookies will still be used on the site. This is similar to the previous “cookie notification banner,” which did not require consent.

To comply with the GDPR, nbamaniacs’ advertising partners will not serve personalized ads to users in Europe unless prior consent is explicitly given through this tool.

Clickio acts as a data processor for nbamaniacs. Clickio commits to processing personal data from the publisher’s website only on behalf of the publisher and strictly according to the publisher’s instructions. Clickio serves ad impressions via ad exchanges and providers explicitly approved by nbamaniacs.

Change your privacy settings by clicking here.

More information on how Clickio and its tool comply with GDPR is available here.

8. What rights do you have over your data?

Anyone has the right to obtain confirmation as to whether nbamaniacs processes personal data. Interested parties have the right to:

  • Request access to personal data concerning them
  • Request its correction or deletion
  • Request the restriction of its processing
  • Object to processing
  • Request data portability

Data subjects may access their personal data, as well as request correction of inaccurate data or, where appropriate, request its deletion when, among other reasons, the data is no longer necessary for the purposes for which it was collected. In certain circumstances, data subjects may request the restriction of the processing of their data, in which case we will only retain it for the exercise or defense of legal claims.

In certain circumstances and for reasons related to their particular situation, data subjects may object to the processing of their data. nbamaniacs will stop processing the data, except for compelling legitimate reasons, or for the exercise or defense of legal claims. As a data subject, you have the right to receive the personal data concerning you, which you have provided to us, in a structured, commonly used, and machine-readable format, and to transmit it to another data controller when:

  • The processing is based on consent.
  • The data has been provided by the data subject.
  • The processing is carried out by automated means.

When exercising your right to data portability, you have the right to have personal data transmitted directly from one controller to another, where technically feasible.

You also have the right to effective judicial protection and to lodge a complaint with the supervisory authority, in this case, the Spanish Data Protection Agency, if you believe that the processing of your personal data violates the Regulation.

How long will we retain your data?

Personal data provided via email will be retained until deletion is requested by the data subject.

IP data obtained through Google Analytics will be retained for 26 months.

nbamaniacs does not hold any other types of user data.

The data that we can view but do not possess from the Disqus or Spot.IM comment systems are held by Disqus and Spot.IM. They will retain that data for as long as you use their comment systems on nbamaniacs or any other site worldwide that uses them. You can modify or delete all your data from Disqus and Spot.IM through your user account on those platforms.

Data secrecy and security

https://nbaen.top is committed to the use and processing of users’ personal data with respect for its confidentiality and will use it according to the intended purpose. We also fulfill our obligation to store and safeguard it, adopting all measures to prevent alteration, loss, unauthorized access, or processing, in accordance with current data protection regulations.

This website uses an SSL certificate. It is a security protocol that ensures your data travels safely and encrypted — in other words, the transmission of data between a web server and user, and in return, is fully encrypted.

https://nbaen.top cannot guarantee absolute invulnerability of the Internet network and therefore cannot prevent fraudulent access to data by third parties.

Regarding processing confidentiality, nbamaniacs ensures that any person authorized to process customer data (including staff, collaborators, and providers) is under an appropriate confidentiality obligation (whether contractual or legal).

As a user, you are solely responsible for the accuracy and correctness of the data you submit to https://nbaen.top, https://disqus.com, https://stripe.com, or https://memberful.com, and you release nbamaniacs from any responsibility in this regard.

Users guarantee and are responsible, in any case, for the accuracy, validity, and authenticity of the personal data provided, and they commit to keeping it properly updated. The user agrees to provide complete and correct information when contacting nbamaniacs, using the Disqus or Spot.IM comment system, or subscribing through Memberful, Stripe, and Mailchimp.

Acceptance and consent

The user declares to have been informed of the conditions on personal data protection, accepting and consenting to the processing of their data by nbamaniacs in the manner and for the purposes stated in this privacy policy.

Revocability

The consent given, both for the processing and transfer of data of the data subjects, is revocable at any time by notifying nbamaniacs as established in this Policy for exercising ARCO rights. This revocation will not have retroactive effect under any circumstances.

9. Final point of nbamaniacs’ Privacy Policy

Our principles regarding your privacy:

  • We never request personal information unless you want to use the comment system, in which case you must identify yourself with a username, email, or social media account through Disqus or Spot.IM, our comment systems. The data you provide in that case belongs to Disqus or Spot.IM respectively, as they are the data controllers.
  • The personal information you provide when subscribing to nbamaniacs (free or paid) is NEVER shared with third parties except for Memberful, Stripe, and Mailchimp — companies detailed in section 2 of this privacy policy and essential to providing our subscription service.
  • Personal information collected simply by visiting the site is captured by our advertising partners and the analytics system (Google Analytics). You can choose not to receive personalized ads by clicking here.
  • We never share users’ personal information with anyone, except to comply with the law or with your express authorization.
  • We never use your personal data for any purpose other than those stated in this privacy policy.

Please note that this Privacy Policy may vary due to legislative or self-regulation requirements. We advise users to check it regularly.

nbamaniacs has adapted this website to the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 (GDPR).

Principles we apply to your personal information

  • Lawfulness, fairness, and transparency: we will always require your consent (if we ever request your data) for one or more specific purposes, which we will inform you about clearly beforehand.
  • Data minimization: nbamaniacs does not request any data unless you are a subscriber. To use the comment system, you must provide your personal data to Disqus or Spot.IM. If you become a free or paid subscriber, we will only use your data to provide our subscription services.
  • Storage limitation: data will be retained for no longer than necessary for the purposes of the processing.
  • Integrity and confidentiality: your data will be processed in a way that ensures appropriate security and confidentiality, in line with the policies of our partners — Google, Clickio, Disqus, Spot.IM, Memberful, Stripe, and Mailchimp.

Commercial emails

In accordance with the LSSICE, https://nbaen.top does not engage in SPAM practices of any kind. If we send any email, it is because you have given us your consent to do so.

In accordance with Spanish Law 34/2002 on Information Society Services and Electronic Commerce, https://nbaen.top agrees not to send commercial communications without properly identifying them.

Changes to the privacy policy

nbamaniacs reserves the right to modify this policy to adapt it to legislative or case law developments, as well as industry practices. In such cases, nbamaniacs will announce the changes on this page with reasonable advance notice before implementation.
